Lawyer for alleged drunk driver who killed Cecilia Nache motions to dismiss stolen vehicle charge

The hearing on the motion to dismiss will be held on Nov. 29.

ROCK ISLAND COUNTY, Ill. — Editor's note: A previous version of this story incorrectly stated that Griswold's lawyers sought to dismiss the case in its entirety, rather than just one charge. The story has been updated with this correction.

The defense team of the woman accused of driving drunk and killing Cecilia Nache in August 2021 has motioned to dismiss her stolen vehicle charge in a hearing held on Nov. 3.

Brittany Griswold, 36, of Geneseo is facing several charges in the summer crash, including driving under the influence, involuntary manslaughter and reckless homicide, and possessing a stolen vehicle.

News 8 has spoken with her sisters Blanca Leal and Elizabeth Nache about the pain they've felt since that night and how they just want justice.

"She is not the victim here. Maybe it was a mistake," Elizabeth Nache told News 8 in September during a demonstration outside of Griswold's pretrial hearing. "But that mistake caused a huge consequence that affected other people, not just herself. And that accountability is important to take on and responsibility."

After the crash, responders transported Griswold to a hospital and she was arrested. However, she didn't get a mugshot until over a year later. She's since been out on recognizance bond rather than bail, meaning she won't pay any amount of money unless she misses a court date.

The hearing on the motion to dismiss will be held on Nov. 29.
