NEW YORK (AP) — It’s the Feds versus Apple over an encrypted iPhone; but it’s not the case involving the iPhone belonging to one of the San Bernardino terrorists.

A New York judge says the Feds cannot force Apple to give the FBI backdoor access to locked iPhone data in a routine Brooklyn drug case. U.S. Magistrate Judge James Orenstein made the ruling Monday, February 29, 2016.

The decision follows a California judge’s order requiring Apple to create new software. It would help the Feds hack the iPhone of a shooter in the Dec. 2 killing of 14 people in San Bernardino, California.

Tuesday, a congressional panel was expected to hear from FBI Director James Comey and Apple General Counsel Bruce Sewell on the issue of balancing security and privacy.
